1. Acceptance of Terms  Experiential Systems, Inc. (" ESI " or "we", "us", "our"), provides public access to the ESI websites, located online (the "Site"). The use of the ESI Sites is subject to your acceptance of this Website User Agreement ("Agreement").

 

By accessing, browsing, framing, using and/or linking to the Site, you become a User (defined herein) and agree to be bound by the terms of this Agreement. When using a particular feature of the Site, you may also be subject to any posted guidelines, rules, terms of service, privacy policies, or other contractual provision as noted. In the event of a conflict between any other agreement, rule, policies, or terms of service and this Agreement, the provisions of this Agreement shall govern. 2. Types of Users Any person accessing, browsing, or otherwise using the Site, either manually or via an automated device or program, shall be deemed a "User" under this Agreement.

 

 3. Returns and Exchanges VERY IMPORTANT! All Returns must comply with our 30 Day Return Policy. You will be charged a RESTOCKING fee if your return is older than 30 days and it may be returned to you at your own cost. If your return is older than 30 days, please call us at (877) 206-8967 to verify that your return will not be refused. Any return that does not meet the return criteria is subject to a restocking fee and possible delivery rejection. Thank You.

We Offer a 30 Day Guarantee on purchases as long as the product is still in BRAND NEW CONDITION.

Any new product (*exceptions are listed below*) may be returned within 30 days of shipment if you are unsatisfied for any reason. Returns must still be in brand new condition and have all the tags packaging and stickers still attached. You will be charged between 10% and 30% for missing or damaged packaging, tags and any other item that assists in the sale of the item.

Return Exceptions: Items which we can not accept for returns due to safety reason and state laws: Any and All climbing gear, CLOSEOUT ITEMS, sunglasses, goggles, long underwear, hydration packs, Computer software that has been opened, water bottles or any other product that may be used by your mouth, special order items which we do not normally carry or modified product requests from the manufacturers. Products that have been used at all may not be returned at any time.

REFUSED PACKAGES
Unless you have called to receive approval prior to refusing delivery on a shipment to you, you will be charged a restocking fee of 20% to 40%. Packages that are refused will not receive a full refund UNLESS prior arrangements have been made and the shipping department is aware of your refusal and the reason for refusal. There are no exceptions to this policy.

Refund Policy
We will refund you the full purchase price of any product returned following the guidelines outlined on this page. Shipping and Handling will not be refunded unless we shipped an incorrect item or an error was made on our part. You are responsible for shipping charges for sending back all products. If you are asked to ship an item back that was incorrect, we will send you an electronic pre-paid UPS shipping label at no charge.

Returns Older than 30 Days
In addition to any other fee's (Missing Tags, etc.) Items sent back that have been purchased more than 30 days ago will be subject to an additional 20% restocking fee per 30 days. For example: and item 31 days old will be subject to a 20% restocking fee. Items 61 days old will be subject to a 40% restocking fee. Items 91 days old will be subject to a 60% restocking fee. Items 121 days old will be subject to an 80% restocking fee. Items over 150 days old will not be accepted and will be returned to you.

Returning products that have been Used and are No Longer in New Condition
In addition to any other fee's (Missing Tags, etc.) Items sent back that have been used and are no longer in BRAND NEW CONDITION will be refunded a MAXIMUM of 50% of the lowest price offered. No used gear will qualify for a full refund. The Returns Department will determine the refund percentage based on how "used" the product is. All used returns will have a minimum of a 50% restocking fee and may be as high as 80% depending on the condition of the item. If the product is damaged and needs warranty, we suggest you contact the manufacturer directly.

CLOSEOUT ITEMS
Items marked as Closeout (Specified by either "closeout" in the name of the item OR within the status of the items availability) may NOT be returned, exchanged or credited under any circumstance. Closeout items are offered at deep discounts with the understanding that they are sold as is and are not returnable. Closeout items shipped back to us will be refused and returned to you at your own cost. If you have a closeout item you purchased that you no longer want, we always suggest ebay.com as a viable way to get rid of your product.

4. Price Matching Rules Experiential Systems offers a Price Match option on almost any product. We do reserve the right to decline to match a price, but in most cases we will honor price match requests with other websites.

 

In order to qualify for a price match consideration, the following conditions and rules must be met:

 

1) The product must be in-stock and ready to ship that day on the lower priced site. Backorders will not be matched and we do not match prices on items that are out of stock.

 

2) The item must be EXACTLY the same as the product you want to order from us. Same color, size, year, model, etc.

 

3) The product must be the same year. We do not price match on closeouts from previous years, scratch and dent items, blems, etc.

 

4) Coupons and promotional codes may not be used with price matches, either from our site or from a competitor’s coupon.

 

5) Shipping prices will be met as well in the event that the lower priced site has a more expensive shipping charge.

 

6) The Product must be orderable online. Online advertisements are not honored unless the product can be ordered online through a secure server with a functioning shopping cart.

6. Declined Credit Card and Address No-Match Policy if your credit card is declined or if the billing address you provide us does not match the billing address on file with your credit card, we will contact you via email to notify you. We will not make any phone calls, so please make sure that you provide an accurate e-mail address and check your e-mail after you place an order.

If your credit card is declined or you do not provide a correct billing address, the products that you ordered will no longer be held for you, so it is important that you respond as quickly as possible so that we do not sell out of the item you have ordered. In the event that we do sell out, your order will be put on the backorder list and we will ship it as soon as another shipment arrives.

Any order with a declined credit card or a no match on the billing address will be canceled after 30 days. After 30 days, if we have not heard from you and you wish to still receive you order, you must re-order your product. An email notification will not be sent in the event that your order is canceled after 30 days.

7. Sale Price Rules Experiential Systems and its affiliate sites often times run sales on products.

Sale prices are only valid during the published time and may not be applied to previous orders (unless less than 10 days old, see Price Guarantee Rules).

Sale prices are not honored after a sale has ended.

Coupons are only valid on IN STOCK items. Any item that is marked "SOLD OUT" or "OUT OF STOCK" does NOT qualify for the coupon discount. Any coupon used on an out of stock item will be voided for that particular item and only used on in stock items. UPS Domestic: Ground - If your order is placed M-F, before , your order will usually leave our facility the same day you order it. UPS picks up from our facility at the end of the day during the week, so the following day is considered shipping day number one. 3 Day Select- If your order is placed M-F, before , your order will usually leave our facility the same day you order it. UPS picks up from our facility at the end of the day during the week, so the following day is considered shipping day number one. Your order will arrive on your doorstep in three days, starting with shipping day number one.

2nd Day Air- If your order is placed M-F, before , your order will leave our facility the same day you order it. UPS picks up from our facility at the end of the day during the week, so the following day is considered shipping day number one. Your order will arrive on your doorstep in two days, starting with shipping day number one.

Next Day Air- If your order is placed M-F, before , your order will leave our facility the same day you order it. Next Day Air Saturday Delivery- We can arrange a Saturday delivery for Next Day Air orders placed on Friday, under special circumstances. IMPORTANT EXCEPTIONS: UPS does not pick up or deliver orders on Saturday, Sunday, or major holidays. The days that UPS is not picking up or delivering are NOT considered shipping days. When counting up your shipping days, consider this important information.
Need some help calculating your arrival time? Here are some EXAMPLES:

#1 You place an order for some climbing holds on Friday at and select 3 Day Select shipping. When will you receive your order? UPS does not pick up or deliver on Sat. or Sun. Your order will be processed and shipped from our facility on Monday. Tuesday is considered shipping day number one. So, counting from Tuesday, your order will arrive on your doorstep on Thursday. *

#2 You order carabiners on Thursday at and select ground shipping to Minnesota . When will you receive your order? Your order will usually be processed and shipped on Thursday. Friday is considered shipping day number one. UPS does not ship on Saturday or Sunday. Monday is considered day two. According to the UPS Ground Shipping Timetable estimates, it will take approximately 3-5 days from Indiana to Minnesota , starting with shipping day number one. Your order will arrive sometime between Tuesday and Thursday of the following week. *

#3 You order a tent on Wednesday at 2P.M and select Next Day Air shipping. When will you receive your order? Your order will be processed and shipped on Wednesday. You will receive your order on Thursday - the following day. *

*Experiential Systems is not responsible for UPS ' performance. Once a package leaves our facility, it is out of our hands. If you need to file a claim for a package that was lost during shipping, please contact our shipping department, and we will file the claim, on your behalf, with UPS . UPS only guarantees and accepts claims for fast shipments, (not ground). UPS does not guarantee all air shipments during the Christmas holiday. Please see their website for all details.

USPS:

Priority Mail- We only ship USPS priority mail, which, on average, takes three shipping days. USPS orders are usually shipped the following shipping day, (M-F), after the order is placed. Priority Mail is not guaranteed by Snow Leopard Mountain Sports or the Postal Service. There is no way to track or file claims for orders shipped with the U.S. Postal Service.

 

11. International Users ESI makes no claims that the Content is appropriate or may be downloaded outside of the United States . Access to the Content may not be legal in certain countries or for certain persons. If you access the Site from outside of the United States , you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. Please see more important information about International Ordering.

United States, Canada, Australia, China, France, Italy, Japan, Germany, New Zealand, Spain, United Kingdom, Norway, Sweden, Switzerland, Denmark, Netherlands, Finland, Puerto Rico, U.S. Virgin Islands and the British Virgin Islands.

At this time we are not able to ship to any countries that are not listed above.

INTERNATIONAL SHIPPING

International air orders are sent via UPS . Oversize and/or heavy items may require additional shipping charges. If additional shipping charges apply, you will be contacted for verification and approval before your order is shipped. It is VERY IMPORTANT that you check your email after you place your order because your order will not be shipped if the shipping price needs to be adjusted and Experiential Systems does not get an approval reply from you.

 

DUTIES and Taxes

International orders are subject to duties and taxes. The recipient is responsible for the payment of applicable duties, taxes and other fees. Gift orders may be assessed duty depending on the country. Please contact your customs office for information on duties, taxes and restricted items.

Use of the Site You understand that ESI cannot and does not guarantee that the Sites will be free of infection from viruses or other computer infections that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You are responsible for implementing sufficient procedures (anti-virus software, etc.) and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

These rights are protected in all forms, media and technologies existing now or hereinafter developed. You may print and download portions of the Content from the different areas of the Site solely for your personal non-commercial use. No portion of the Content may be reprinted, republished, modified, or distributed in any form without the express written permission of ESI .

 

You may not, and this Agreement does not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, transmit, sell, distribute, license or create derivative works with respect to the Site. Certain Content may be licensed from third parties and all such third party Content and all intellectual property rights related to the third party Content belong to the respective third parties. You may not remove, alter or modify any copyright, trademark or other intellectual property or proprietary notice or legend contained on the Site or the Content. Any rights not expressly granted by this Agreement or any applicable end-user license agreements are reserved by ESI .

 

Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent or trademark of ESI or any third party. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or rights under any ESI copyright.

Policy Regarding Copyright Infringement and Designation of a Copyright Agent ESI 's policy regarding copyright infringement and ESI 's designated agent for receipt of copyright infringement claims pursuant to the Digital Millennium Copyright Act (17 USC § 512) is incorporated herein and follows below:

 

ESI respects the intellectual property rights of others and requires those that visit our web site to do the same. ESI may, in appropriate circumstances and at its discretion, remove or disable access to material on its web site or its network that infringes upon the copyright rights of others. ESI also may, at its discretion, remove or disable links or references to an online location that contains infringing material or infringing activity. In the event that any visitors to our website or users of our network repeatedly infringe on others copyrights, we may in our sole discretion terminate those individuals' rights to use our website and/or network.

The Rest of the Terms In the event that one or more portions of this Agreement shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such validity, illegality or unenforceability shall not affect any other provision contained in this Agreement. Any delay or failure by ESI , at any time or times, to require performance of any provision hereof shall in no manner affect ESI 's right at a later time to enforce such provision. No delay or failure by ESI in exercising any right hereunder shall constitute a waiver of such right or any other rights hereunder. You may not assign your rights or delegate your responsibilities hereunder without the express written permission of ESI . ESI may, at any time, assign its rights or delegate its obligations hereunder without notice to you. No person not a party to this Agreement is intended to be a beneficiary of this Agreement, and no person not a party to this Agreement shall have any right to enforce any term of this Agreement. This Agreement and any documents expressly incorporated by reference constitute the entire agreement between ESI and you pertaining to the subject matter hereof.

 

 In order to protect our customers ESI reserves the right to ship packages signature required.

 

26. Updates and Modifications In its sole discretion, ESI may unilaterally amend or modify this Agreement or any other documents referenced herein at any time by posting the amended Agreement on the Site. Any amended or modified terms will be effective upon posting. Continued use of the Site constitutes acceptance of any modified terms and conditions.
